Sponsoring a valuable employee can be an essential recruitment strategy as the truly prized foreign employee will rarely make long term commitments on a temporary visa.

The Federal Skilled Worker Program (FSWP) offers a company-track whereby an employer can petition an employee’s permanent residency under a separate category of the FSWP; often referred to as “FSW2” for “Category 2” or “Arranged Employment.”

FSW2 is similar to the regular federal skilled worker program in many ways. The program is points-based, where an assessment of an applicant is a product of experience, education, age, language proficiency and various “adaptability” criteria.

Most permanent resident sponsorships are made when a Client is already in Canada on a valid work or study permit. These “flips” form the vast majority of company-based sponsorships. While rare, FSW2 is also available to employers who find the perfect candidate and wish to sponsor his permanent residency (PR) without going through the initial work permit phase. The ability to sponsor a foreign applicant overseas is a unique feature of FSW2 and is not available under the Provincial Nominee Program (PNP).

Similar to our federal skilled worker offering, our firm will prepare government forms on behalf of the company sponsor and employee (foreign worker) and assemble relevant supporting documents. We also prepare the required Labour Market Impact Assessment (LMIA) (LMO) (previously an Arranged Employment Opinion or AEO) including the coveted and ESDC-compliant job offer letter and, where required, the 4-week mandatory job advert campaign. We additionally represent the foreign worker in all government and official correspondences at the Embassy or Consulate.
