Court Records
Subject to time constraints and urgency, the obtaining of court records, preferably certified records, is an indispensable tool to securing a waiver (TRP) or rehabilitation decision by Canada.
We encourage all our customers to obtain certified court documents on their own by contacting the relevant county court clerk.
If you recall the county where the conviction occurred, simply Google/Yahoo “county court clerk” along with the relevant county to obtain the clerk’s information. Then contact the county clerk to obtain certified copies of your court disposition.
In most cases, the request is sent in writing via a special form. In other cases, you can visit the court house in person to obtain the required certified copies or send a fax. For older offences, a record may require a visit to the archives or may not exist at all due to retention policy. (Misdemeanor convictions are generally destroyed following six years of a closed offence – if not record is found due to retention policy, be sure to have it in writing!)
For clients who are in a hurry, or don’t have the time to obtain court documents, or don’t wish to obtain it for whatever reason, may contract our office to obtain Citizenship Immigration Canada (CIC)- or Canada Border Service Agency (CBSA)-compliant court records in support of a TRP or rehabilitation packet.
Deliverables with respect to the obtaining of court records are as follows:
- Filling out of required court form and research of case number as required
- Correspondence to/from the office/court
- Ensure that the court disposition meet the CIC/CBSA requirements
- Includes shipping to/from the court house to/from the office
- Payment of all court costs
- Escalation where required (if an error is suspected or a correction is needed)
